Federal and state rules and regulations on distilling can be very difficult to navigate. They're antiquated, confusing, and even contradictory. Clawhammer has been selling stills since early 2009 and we've been carefully navigating the waters of distillation regulation from the very beginning.
Here's a bit of Clawhammer trivia (read carefully, it gets confusing): We originally wanted to headquarter the business in North Carolina. However, the North Carolina ABC informed us (as a response to our inquiry) that operating a business in NC that produces and sells distillation equipment (even if it's just a kit) isn't possible, according to the state's laws. However, individuals CAN buy distillation equipment in North Carolina. Confusing, huh.
So, to clarify, Clawhammer CAN ship still kit to NC from another state, and residents of North Carolina are allowed to purchase distillation equipment (assuming they're using them for legal purposes, they have the proper permits, etc.). However, our business cannot be located in NC due to century old prohibition era laws that prevent businesses from selling distillation equipment in this state.
Since we weren't able to operate in NC, we decided to open the business in Tennessee. They were actually very accommodating. We received permission to operate in TN directly from the state's ABC Executive Director and we worked with some great people in that state.
In late 2011, we moved the entire business to Colorado, which is our current home. We're currently headquartered in Fort Collins, CO. We manufacture all of our equipment and manage all of our operations from here.
We love the Blue Ridge mountains and we'd love to move back. We've actually approached the NC ABC several times, requesting that they approve our move back to that state. Unfortunately, they've continued to deny our request!
Recently, we've decided to take a different strategy. We're going to voluntarily suspend sales to NC. The NC ABC has not asked us to do this. We've made an internal decision to do so. Basically, we're trying to form a better relationship with the NC ABC convey the true nature of our business to the: our kits are for law-abiding, good-natured individuals who aren't out to defraud the state government out of alcohol tax money.
With that said, if you live in NC and want to buy products, you're out of luck for the time being.
