RETURNS, REFUNDS & WARRANTY

We offer full refund, no questions asked, on complete, unused, unmarked, products within 30 days of purchase. Return shipping is buyer’s expense. If the product has been used or modified in any way, we will not accept the return.

We offer a 1 year warranty on everything we sell. If one of our products is compromised or fails due to poor workmanship, we will offer new parts, we will repair the item, or we will replace it at our cost. This warranty does not cover items that are lost or stolen, or are damaged due to improper use. In those cases the customer will be responsible for repairing or replacing the item.

PRIVACY POLICY

We save name, address email, order information for the purpose of warranties and customer service. We do not sell or otherwise disseminate this information to any third party for commercial purposes. Additionally, we keep serial numbers for distillation equipment for a period of 3 years after purchase as required by the federal law. The federal Tax and Trade Bureau (TTB), the federal agency that regulates alcohol distillation in the United States, has the authority to make distillation equipment manufacturers report the purchaser information and equipment serial number. If requested, it will be supplied to the TTB. However, the TTB does not currently collect this information. It is our policy to only provide information requested by the TTB. In some rare cases, if contacted by local law enforcement, we may provide a subset of data to local law enforcement. At most the only information that we provide to any government or law enforcement agency will be your contact information and the serial number (and type) of equipment that you purchased. We will do our best to inform you if your limited information has been or will be provided to any third party.

Mobile Terms of Service

The Clawhammer Supply mobile message service (the "Service") is operated by Clawhammer Supply (“Clawhammer Supply”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Clawhammer Supply’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Clawhammer Supply through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Clawhammer Supply. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18559174726 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Clawhammer Supply mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

All products sold are intended to be used in accordance with the proper licensing or permitting procedure of the respective jurisdiction of the user. By your purchase of any of our products, you acknowledge and agree that you have read this disclaimer will comply with all such State or Federal law, regulation or statute regarding the use of any product that you have purchased from us.

ADDITIONAL TERMS AND CONDITIONS FOR SALES OF DISTILLING EQUIPMENT

The use and possession of stills and other distilling equipment is heavily regulated by foreign, federal, state, and/or local laws. Distillation of alcohol for consumption or other use in the United States (and various other jurisdictions) without required federal and, where applicable, state licenses or permits is illegal and could result in jail time, fines, forfeiture of property, or other penalties.  If you purchase distilling equipment supplied by Clawhammer Supply, LLC. you expressly represent and warrant to Clawhammer Supply, LLC. that you will comply with (i) all laws applicable to the possession, use and operation of such equipment; (ii) all instructions for the use and operation of such equipment, and (iii) you waive any claims against Clawhammer Supply LLC, its owners, officers, directors, employees, or agents for any misuse of the equipment for any purpose other than which it was designed.

Clawhammer Supply, LLC. supplies stills and other distilling equipment in jurisdictions throughout the world, including in areas that may not require licenses or permits for the distillation of certain volumes of alcohol or the distillation of alcohol for non-commercial use. Accordingly, if you view any marketing or other communications related to stills or other distilling equipment supplied by Clawhammer Supply, LLC. that appear to indicate that the equipment may be used to distill alcohol, such communications shall be deemed to include the phrase "with all required licenses and permits and in accordance with all applicable laws."

IF YOU PURCHASE, POSSESS, USE OR OPERATE ANY STILL OR OTHER DISTILLING EQUIPMENT SUPPLIED BY CLAWHAMMER SUPPLY LLC, YOU AGREE AND ACKNOWLEDGE THAT DISTILLING ALCOHOL CAN BE DANGEROUS AND INCLUDES RISKS INCLUDING, BUT NOT LIMITED TO, FIRE, EXPLOSION, AND/OR THE PRODUCTION OF SUBSTANCES THAT MAY BE ILLEGAL OR POISONOUS AND THAT YOU FULLY UNDERSTAND AND APPRECIATE SUCH RISKS AND KNOWINGLY AND VOLUNTARILY AGREE TO ASSUME ALL SUCH RISKS.

If you purchase, possess, use, or operate any still or other distilling equipment supplied by Clawhammer Supply, LLC. you further agree to defend, indemnify, and hold harmless Clawhammer Supply, LLC. from and against all damages, penalties, losses, claims, suits, other proceedings, and expenses of every kind or nature, whether in contract or tort, including all reasonable attorneys’ fees and costs (collectively, “Losses”), arising from the ownership, possession, use, or operation of such still or other distilling equipment, regardless of whether such Losses are reasonably foreseeable and including Losses related to personal injury or death to you or others. You acknowledge and agree that the foregoing agreement to indemnify, defend and hold Clawhammer Supply, LLC. harmless and the limitation of liability contained herein are integral parts of the transaction to which these Terms and Conditions relate and that without such provisions Clawhammer Supply, LLC. would not have entered into such transaction with you.

If you resell or otherwise transfer any still or other distilling equipment supplied by Clawhammer Supply, LLC. you agree that: (i) you possess appropriate product liability, commercial general liability, and other insurance coverage in amounts and types sufficient to protect against all reasonably foreseeable claims related to the stills or other distilling equipment you purchased from Clawhammer Supply, LLC.; (ii) you will obtain from any transferee their express agreement to all of the terms and conditions herein contained; (iii) you will not assist or recommend that the transferee act in violation of such terms and conditions or any applicable laws or regulations, and (iv) all warranties, express or implied, by Clawhammer Supply LLC are null and void – any warranties, express or implied, by Clawhammer Supply LLC inure to the benefit of the initial purchaser only, such warranties are not transferable.

Any questions related to the lawful purchase, possession, use, or operation of distilling equipment, including stills, or the effects of these terms and conditions, should be directed to a legal advisor licensed to practice law in your jurisdiction.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Clawhammer Supply, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by Clawhammer Supply LLC.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

ENTIRE AGREEMENT

The failure of Clawhammer Supply LLC to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by Clawhammer Supply LLC on this site or in respect to the products, equipment, or goods sold by Clawhammer Supply LLC constitutes the entire agreement and understanding between you and Clawhammer Supply LLC and govern your purchase from Clawhammer Supply LLC, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and Clawhammer Supply LLC (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Colorado, United States.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the Clawhammer Supply LLC website or purchase from Clawhammer Supply LLC following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
